Al-marri is being held at a brig in South Carolina. He is an American citizen that came to the country on September 10th, 2001. The government arrested him in 2003 on credit card fraud. Then, a few months later, Bush declared him an 'enemy combatant' which means that he is stripped of all of his rights. He has never seen trial and has been locked away in a military prison since than. How can they do this? Well Government lawyers told federal judges that the president can send the military into any U.S. neighborhood, capture a citizen and hold him in prison without charge, indefinitely.
Oh. I'm sorry, what does the fourth amendment say again?
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
